A compromise agreement may be used by an employer in the following situations:

 

1) if the employee has a claim against the employer; and

2) the employer or employee wants to attach conditions to the termination of employment.

 

A Compromise agreement will allow the employer to terminate employment without following the usual procedures required by law.  You will usually receive a sum of money you sign and agree to the terms. In order to create a legally binding agreement your employment solicitor will ensure that it:

 

1) relates to a specific complaint or named proceedings;

2) is in writing; and

3) legal advice has been obtained by the employee from an independent source.
